Rio Vista Village, L.L.P. v. Leidenfrost Horowitz & Associates, et. al.,

Result: Settlement of claims and recovery of judgments recovered against non-settling subcontractors.

This matter involved alleged construction deficiencies at a 75 unit, low-income housing project, commonly referred to as the Rio Vista project located in the City of Boyle Heights, which was developed by the owner/developer/plaintiff, primarily through federal tax credits. Our firm represented the general contractor, the prime target defendant, in an action where plaintiff sought damages in excess of $20 million. Our firm was able to resolve this matter by reaching a complex settlement with the plaintiff that involved a $2 million cash payment and an assignment of various contractual rights. In the end, plaintiff was able to recover in excess of $14 million from the various subcontractor defendants, and our client and carriers were able to participate in the recovery.
