Brian C. Merges is a Partner with Sabaitis • O’Callaghan, LLP. Mr. Merges represents individuals and businesses in a wide variety of complex litigation matters, including product and premises liability, construction defect claims, real estate development, personal injury, and toxic torts. Mr. Merges’ representative matters include:

• Drafted and argued successful motion for summary adjudication regarding strict liability and punitive damages for real estate developer client in matter involving mass property damage suffered during flood event.

• Achieved dismissal of foreign manufacturer client in product defect matter through motion to quash regarding court’s lack of personal jurisdiction.

• Obtained nominal settlement on behalf of construction manager client in construction defect matter involving the modernization and renovation of public institution structures.

• Secured emergency protection orders preventing transfer or diminution of various assets held by corporate and individual defendants in business litigation/fraud case.

Mr. Merges graduated from Boston College with a Bachelor of Science degree in both Finance and Accounting in 1997 and was admitted to the California Bar in 2002 after graduation from Northeastern University School of Law. He served as an intern for the United States Attorney for the Southern District of New York and the United States Securities and Exchange Commission while in law school. Prior to studying law, Mr. Merges was a Senior Associate in the Financial Services division of PricewaterhouseCoopers in Boston.

SABAITIS O’CALLAGHAN SUCCESSFULLY ARGUES TWO WRIT PETITIONS BEFORE THE CALIFORNIA COURT OF APPEAL
Sabaitis O’Callaghan is pleased to announce that it recently successfully argued two writ petitions before the California Court of Appeal. The writ petitions requested that the Court of Appeal overturn two Superior Court decisions holding that our client, Far Fabbri, S.R.L., was subject to personal jurisdiction in California.
