Brian C. Merges is a Partner with Sabaitis • O’Callaghan, LLP. Mr. Merges represents individuals and businesses throughout the litigation process in various types lawsuits, including construction defect, breach of contract, product liability, and personal injury actions. Mr. Merges’ construction defect practice includes representation of general contractor, construction manager, and subcontractor clients in matters involving residential, commercial, and public works projects. In addition, he regularly represents product manufacturers, distributors and designers in product defect / catastrophic personal injury actions.
Recent representative legal work includes:
• Drafted and argued successful motion for summary adjudication regarding strict liability and punitive damages for real estate developer client in matter involving mass property damage suffered by downstream property owners during flood event.
• Achieved dismissal of foreign amusement ride manufacturer client through motion to quash regarding court’s lack of personal jurisdiction in product defect case.
• Obtained judgment exceeding $2 million, including domestic and foreign attorneys fees, on behalf of foreign real estate developer client in fraud / breach of contract case pertaining to the financing of a condominium project.
Mr. Merges serves as a Mandatory Settlement Conference referee for the Los Angeles County Superior Court and was named as a Top Attorney by Pasadena Magazine in 2009 and 2010.
Mr. Merges graduated from Boston College with a Bachelor of Science degree in both Finance and Accounting in 1997 and was admitted to the California Bar in 2002 after graduation from Northeastern University School of Law. He served as an intern for the United States Attorney for the Southern District of New York and the United States Securities and Exchange Commission while in law school. Prior to studying law, Mr. Merges was a Senior Associate in the Financial Services division of PricewaterhouseCoopers in Boston.
